      We assist throughout the transaction – from the preparatory stages where business structure and financing issues are addressed and through the due diligence process, culminating in the drafting and negotiation of agreements. Of course we also follow up on each transaction and advise our clients on an day-to-day basis on the various real estate issues that follow from it.

    • Commercial leases and other management issues

    • We support our clients with all of the legal questions that arise in connection with the management and improvement of real estate. The lawyers in Foyen’s real estate group have a wide range of experience in handling a variety of management issues and we also have a strong understanding of how a redevelopment project should be planned and implemented to achieve the best possible results.

      We work on an ongoing basis with tenancy issues and other questions that arise in the management of properties for purposes such as retail (shopping centres, pop-up leases, co-working agreements. etc.), offices (head office leases, co-location leases, co-working, etc.), restaurants (fine dining, fast food, food halls, etc.) and various types of residencies (hotels, tenant-owner projects, long stay, student residences, etc.).

      We also advise on the drafting of lease agreements in complex construction projects, draw up standard agreements, and participate in rent renegotiation. We regularly represent our clients in disputes before rent tribunals and courts of general jurisdiction.       Our assistance may include aspects such as reviewing development agreements or agreements for the acquisition of undeveloped land, reallotment agreements and land parcelling issues, reviewing local development plans, dealing with existing tenants and leaseholders, advising on entering into leases before construction is completed, procuring construction contracts and, finally, advising on whether the entire project should then be sold.

      We also assist our clients with commercial matters related to residential property rights, as well as with matters relating to land use law such as utility easements, expropriation, and common facilities.
