The Court of Appeal’s judgment establishes the start date for calculation of the contract period, i.e. when the first day of operation is to be deemed to have occurred, as well as when the other party is to be deemed to have terminated the contract, i.e. the start date for the notice of termination period. As a result of the judgment, our client has been awarded full compensation for the subscription fees plus accrued interest, and this judgment in our client’s favour is a modification of the lower court judgment. The judgment became final and binding on 11 May 2022.
