Foyen has successfully represented Folkets Bygg in the Court of Appeal for Skåne and Blekinge. Partner Richard Sahlberg, senior associate Fanny Herbe, and associate Erik Jagbrant from Foyen were involved in the matter.
The case centered on an extensive attic-to-apartment conversion project involving several properties. MKB, the municipality of Malmö’s public housing company, had contracted Folkets Bygg and subsequently terminated the agreement. The case was filed in the District Court of Malmö in 2016 and the main question was whether MKB had grounds to terminate the agreement. The District Court found in favour of Folkets Bygg and ordered MKB to pay Folkets Bygg damages and compensation for work already carried out. In a new trial in the Court of Appeal, it was held that there were no grounds for termination by MKB and the Court of Appeal therewith upheld the decision of the District Court.
